A GUIDE TO THE WAYBILL

At MOL, we have introduced the waybill to meet our customers' needs for faster and more reliable service. Have you ever experienced a frustrating incident when the B/L was delayed or lost, resulting in the late receipt of the cargo? Moreover you may have been forced to maintain a bank L/G to receive a delivery order. We believe the use of the waybill will put an end to problems like these and ensure smoother, more efficient cargo deliveries. Additionally, the waybill is practical for assuring safe export, import, and crosstrade business. We hope this explanation help you, our customers, make good use of the waybill in future business transactions.

What's the difference between the waybill and the B/L?
In short, the waybill serves as both the cargo receipt and the contract of carriage. In this regard, it is the same as the B/L. So where does the difference lie? In a word, security. The waybill is a non-negotiable instrument; it can't be transferred by endorsement. There is no need to present the waybill to the carrier at the time of cargo delivery. The cargo is immediately delivered to the consignee once the carrier identifies the receiver as the actual consignee stated in the waybill. Therefore, the waybill always has one specific consignee; it isn't issued "to order."
What are the advantages of using the waybill?

From the shipper's point of view : Safety and simplicity
As we explained, the shipper is not required to send the waybill to the consignee, because the waybill doesn't have to be presented at the time of cargo delivery. Therefore shipping documents such as insurance bonds and invoices can be sent prior to the issuance of the waybill. If the consignee does need the waybill, the shipper can mail the waybill with no worries of it being misused by another party if it's lost. This is one of the waybill's key advantages over the B/L.

From the consignee's point of view : Prompt delivery and reduced costs
Since consignees can receive cargo immediately after its arrival without presenting the waybill, they can save money on storage charges. And they never have to arrange a bank L/G even if the waybill is delayed or lost, as they do when the same happens to the B/L. This also means lower costs and more convenience.

What's the difference between the contracts of carriage for the waybill and the B/L?
If you refer to the reverse side of the waybill, you can see that the terms of the contract for carriage are very similar to those of the B/L. However, there are slight difference regarding cargo insurance coverage, which varies from country to country. So we recommend that you contact your cargo insurance company prior to shipment and notify them that you intend to use the waybill.
What type of business is suitable for using the waybill?

The waybill is best suited for business that doesn't require shipping documents as collateral, such as:

Business between a company head office and its overseas branch or affiliate.
Business between long-standing, reliable customers.

If the L/C requires the waybill as collateral, it can be used as a shipping document instead of the B/L. Here's how it works.

First, designate the L/C opening bank as the consignee for the waybill and the actual consignee as the notify party. Then, after the price settlement has been verified, arrange for a release order to be issued from the opening bank to the shipping line. This release order requests the shipping line to deliver the cargo to the actual consignee.

In addition, L/C business usually requires a "SHIPPED B/L." Like the B/L, the waybill can also indicate that the cargo has been shipped, simply by adding an onboard notation.

Is it possible to issue both the waybill and the B/L?
We can provide either, depending on the shipper's requirements. However, we can't issue both for the same shipment. Some countries have restrictions on the use of the waybill. We will inform you beforehand if this is the case with your shipment.
How many waybills are issued?
In principle, we issue only one original waybill.
Is it possible to exchange the B/L for the waybill and vice versa?
The B/L and the waybill may be used interchangeably if the request is made prior to the vessel's sailing. Please notify us immediately in that case, and submit a full set of the original B/L or waybill to our branch office or agent.
Is it possible to change the place of delivery, the discharging port, and/or the consignee?
Since MOL's waybill is based on CMI (=Comite Maritime International) Uniform Rules for Sea Waybills, the shipper may request changes in the place of delivery, discharging port, and/or consignee. When applying for such changes, please present the waybill to our branch office or agent. Though all changes are subject to the vessel's schedule, the stowage of cargo on board, and rules of the shipping conference concerned, we will do our best to meet your request.
How is cargo delivery carried out?

There is no need to present the waybill at the time of cargo delivery; however we have to positively identify the cargo receiver as the consignee specified in the waybill. We appreciate your cooperation in following the procedures outlined below:

Prior to the vessel's arrival at the designated port, we will send the arrival notice to the notify party indicated in the waybill. After signing the arrival notice, please bring it to our branch office or agent, where we will issue a delivery order to the cosnignee. If anyone other than the consignee is to bring the arrival notice, please indicate the name of this person, to be referred to as the deputy, in the arrival notice.

If the consignee or notify party is located far from the place of delivery, making it inconvenient to sign the arrival notice, please notify our branch office or agent of the name of the deputy who will receive the delivery order instead.
